Two Commissioners, One Party, No Statute: What Democrats Inherit On Crypto

Democrats won control of the House and Senate on Nov. 3, and will chair the committees overseeing crypto market structure when Congress is seated in January. The SEC has two sitting commissioners of five, and the CFTC has one of five, all Republicans, and the two agencies signed a memorandum of understanding to coordinate their work. Congress still has not passed a crypto market structure law, and Democrats are preparing their own bill, though no text has been released.
